The Forum of Free Enterprise is a non-political organization founded in 1956 by A. D. Shroff, and has been established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet titled ‘The reform of the Judiciary by Justice’ is authored by H.R. Khanna and published in 1980. The author explains how freedom of enterprise is intrinsically linked to freedom of expression. He elaborates how law has been used to facilitate or curb freedom accordingly and why judiciary plays a crucial role in democracy. He recommends reforms in the stage of appointment, incentives to judges, independence of judges, etc. He then evaluates the working of subordinate judiciary and its shortcomings. He suggests that members of subordinate judiciary must be given accommodation and efforts should be made to keep judicial interpretations free from ideology. He elaborates upon difference of opinions, and how a great judge should be.
