The Forum of Free Enterprise is a non-political organization founded in 1956 by A.D Shroff and was established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet titled, “Property rights under the Constitution ” was published in 1968 and was authored by K. Subba Rao. The author brought the contentions of A.D Shroff in regards to the establishment of an economic system that would be rooted in the principles of freedom. Therefore the author provided a justification for property rights in the Indian constitutional context and the meaning it possessed before its institution. He illustrated two examples for its definition. He further highlighted the conflict between a citizen’s rights and the state’s power to implement the principles. He also provided a glimpse of the various Supreme Court of India’s judgments on the same issue. The author lastly concluded the approach of Constitutional pragmatism as the only plausible way to reach a welfare state.
