The Forum of Free Enterprise is a non-political organization founded in 1956 by A. D. Shroff, and has been established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet is titled “The fundamental rights case” authored by N. A. Palkhivala. The author through the text aims to take the reader through the fight between the government and the citizens on the issue of fundamental rights and the laudable role played by the courts. The author while doing so, discusses lucidly the nature of a constitution in the general sense and the structure of the indian constitution in specific. The author highlights at a very important condition, specific to India, that the “final guarantee of the survival of the citizen’s rights is not the Constitution but the personality and intellectual integrity of our Supreme Court judges.”
