The Forum of Free Enterprise is a non-political organization founded in 1956 by A. D. Shroff, and has been established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet titled “The Supreme Court’s Judgement on the Constitution (42nd Amendment) Act, 1976” was published on June 20, 1980 and was authored by N A Palkhivala. The booklet contains two articles. The first is titled ‘Rekindling The Light of The Constitution’. Mr. Palkhivala examines the Supreme Court’s decision to strike down sections 4 and 55 of the Constitution (42nd Amendment) Act of 1976. This Act had imposed Emergency in an authoritarian manner upon the country and this decision of the Supreme Court was celebrated as a reclaiming of democracy. The second article is called ‘Structure of Marble or of Red Bricks?’. It examines what sections of the Constitution should be unchangeable, and what can be amended to adapt to the times.
