The Forum of Free Enterprise is a non-political organization founded in 1956 by A. D. Shroff, and has been established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet titled ‘The Supreme Court’s judgement in the judges’ case’ is authored by N.A. Palkhivala and published in 1982. The author highlights the importance of independence of the judiciary and evaluates the judges’ case and its four subsidiary issues. He elaborates the issues faced by Judiciary like long judgements, imposed judicial system, etc. The validity of transfer of Justice K.B.N Singh was under question and the Chief Justice of India was considered as a litigant. He elaborates that rejection of State privilege, usage of locus standi were controversial decisions. He points out how the ruling party has tried to undermine the judiciary in the past and why the circular issued by the Law minister is invalid. He further sums up the correct constitutional position.
