The Forum of Free Enterprise is a non-political organization founded in 1956 by A.D Shroff and was established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet titled, “The Role of the Judiciary in Parliamentary Democracy” was published in 2011 and was authored by M.C Chagla. The author focused on the importance played by the Judiciary in India. Furthermore, he highlighted the repudiation of the stands of democracy. The author emphasized the constitutional safeguard of the fundamental rights of the citizens through the judicial check on the inflation of power. He contrasted the Indian judicial case study with that of the American functioning of the courts. Lastly, the author stressed the importance of public opinion in regards to the separation of powers thereby inducing the independence of the judiciary.
