The Forum of Free Enterprise is a non-political organization founded in 1956 by A. D. Shroff and has been established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet titled “Casteism – The Scourge of India” was published on November 15, 1992, and was authored by N.A. Palkhiwala. The author begins by describing the scope and impact of the Mandal case and goes on to summarize its relevant constitutional provisions. He further discusses some of the crucial Supreme Court judgements both for and against the concept of reservations. He argues that the SC judgements favouring reservation policy are erroneous in law and need to be overruled in the national interest and in the long-term interests of the backward castes themselves. He argues that the judgement will give a fresh lease of life to the canker of casteism for a long and indefinite future. He warns that this would lead to the caste being given precedence over merit and calibre. Moreover, he argues that the sections of society which fall outside those designated castes do not qualify for reservations, however socially and educationally backward they may be. He concludes by stating that the government has to decide whether it is in the national interest to open up Pandora’s box in a country that is already plagued by unmanageable problems.
