The Forum of Free Enterprise is a non-political organization founded in 1956 by A. D. Shroff and was established to educate public opinion in India on free enterprise and a democratic way of life. The Forum publishes booklets to further its objects. The following booklet titled, “Fundamental Right To Property” was published on May 10, 1971 and was authored by V. M. Tarkunde. The text talks about liberty and property being the basic concepts in the law of all countries and discusses property as a fundamental right which was guaranteed by two provisions. Further the text covers the limitations on property rights and confiscation of lawfully acquired properties. This booklet consistently took the view that no further abridgement of any fundamental right guaranteed by the Constitution should be attempted unless it is found in a concrete case that any particular aspect of a fundamental right comes in the way of a socially beneficial legislation.
