The Forum of Free Enterprise was a non-political organization founded in 1956 by A. D. Shroff and was established to educate public opinion in India on free enterprise and a democratic way of life. The Forum published booklets to further its objects. The following booklet titled, “Company Law In India” was published on December 10, 1964 and was authored by Justice D.N. Sinha. In this booklet, the author reviews a chequered history of Company Law in India and talks about the English Companies Act of 1844, and an Act for registration of joint stock companies. Then the author discusses how incorporated companies in England were preceded by unincorporated companies. Further the text tells how tax laws contain unnecessary technicalities and are getting worse every day. The author then suggests the need for research in laws which help the government to introduce new laws and reform the existing ones. At the end of the text, the author defines the law with two facets,first one being the ;legislative one and another being the judicial one.
