The Forum of Free Enterprise was a non-political organization founded in 1956 by A.D Shroff and was established to educate public opinion in India on free enterprise and a democratic way of life. The Forum published booklets to further its objects. The following booklet titled, “Crushing burden of taxation” was published in 1958 and was authored by N.A Palkhivala. The author emphasized the separation of powers under the Indian Constitution and contrasted the actual reality of India in the late ‘50s. He highlighted the legislation of tax laws possessing awry features and not accounting for the principles of justice and fair play. Mr. Palkhivala provided few instances as that of the Income-tax Act of 1956, the Wealth Tax Act of 1957, and focused on the drawbacks of such hasty legislations. He further focused on the entirety of tax evasion being unchecked despite the integrated pattern of taxation. Lastly, he accentuated the government’s desire to obtain revenue to remain smaller than the sense of justice and equity.
